Strictly speaking, even if it's non-commercial, you have to use another name. And your own graphics. Most smaller companies don't sue freeware games, but that's completely up to them.

It´s not: Turrican is Factor 5´s trademark if they release a game or not. If you want to do something commercially you have to use another name. Even the non-commercial Turrican games usually stick to somehing without Turrican.

You´d sureley have better and much more feedback if you had created a demo by now, instead of bashing Factor 5. If Turrican Rebirth or whatever is a hoax or not is in no way relevant for your game.

It's not as easy as you make it sound. You have to have a complete dev team ready to work for a year or two. Don't think the current owners of the Turrican rights have that.

I think it's because Manfred Trenz felt a little burnt by Turrican 3D's faliure, so he doesn't want anybody to touch the franchise. Just my theory.
